EPF Form 5 is a simple monthly return used by an employer to tell the Employees’ Provident Fund Organisation (EPFO) about everyone who became an EPF member for the first time in the previous month. Think of it as a fresh-joiners list. When HR follows EPF Form 5 properly, the new employee’s UAN and PF account stay clean, money flows without delays, and audits stay stress-free. This note explains what is Form 5, who prepares it, timelines, the fields to fill, and quick fixes—using plain Indian workplace examples.

What is Form 5?

In short, what is Form 5? It is a register of newly eligible EPF members for a month. If a firm in Pune hires three people in April and all of them come under EPF for the first time, their details go into EPF Form 5 for April. The form is not for monthly contribution amounts; it only lists new members so that EPFO records are updated. Many payroll systems now generate EPF Form 5 automatically, but the responsibility stays with the employer.

Who Fills Form 5?

The employer fills and submits EPF Form 5. Usually, the HR/payroll team prepares it. For contract workers, the contractor is the employer, but the principal employer must ensure compliance. If the employee already has a UAN from a previous job, the same UAN is used; still, the new joining is captured in EPF Form 5 for that month.

Due Date of Submitting Form 5

Submit EPF Form 5 by the 15th of the following month.

Points to Consider Before Filling Out Form 5

  • Confirm the establishment’s PF code is active and linked to the Unified Portal.
  • Collect KYC on joining day: Aadhaar, PAN, bank details, mobile, and address.
  • Ask if the employee already has a UAN; use the same UAN to avoid duplicates.
  • Check prior EPF membership; earlier PF numbers (if any) should be recorded for transfer.
  • Apprentices under the Apprentices Act and interns are generally not EPF members.
  • For wages above ₹15,000, enrolment can still happen if the firm’s policy allows or the person was an EPF member earlier.
  • For international workers, mark the “international worker” status correctly.
  • Keep joining letters and KYC proofs safely; they help during inspections.

Criteria to Submit Form 5

  • At least one employee became an EPF member for the first time in the month.
  • The establishment is covered under EPF (statutory coverage or voluntary coverage).
  • Details are complete and match Aadhaar/PAN to avoid later errors.

Include these fields for each new member:

  • Name of employee
  • Father’s/Spouse’s name
  • Gender and date of birth
  • Date of joining the establishment
  • Whether previously a member of EPF/ESIC (and earlier PF number, if known)
  • UAN (if already allotted)
  • Marital status and nationality (mark “international worker” where relevant)
  • Remarks, employer’s seal and authorised signatory

How to Obtain Form 5?

The format is available on the EPFO website and inside most payroll/HRMS tools. On the Unified Portal, EPF Form 5 data is part of the monthly return workflow; firms usually generate, verify, and keep a PDF/Excel copy for records and audits.

How to Make Corrections in EPF Form 5?

  • For name, date of birth or joining corrections, file a Joint Declaration by Member & Employer with supporting proofs.
  • Reflect the correct details in the next month’s return and in the UAN profile.
  • Keep email trails and stamped copies for inspection history.

Declarations in Form 5

  • The employer certifies that the listed workers became EPF members for the first time in that month.
  • Details provided are true and verified from original documents.
  • Signature, date, place, and establishment seal are affixed.

FAQ

1) I newly joined a company last week. Should I fill and submit Form 5?

No. The employer prepares and submits EPF Form 5. The employee’s role is to share KYC, confirm whether a UAN already exists, and sign forms if the HR team asks for a joint declaration or transfer request. The company then shows the joining in that month’s EPF Form 5.

2) My firm is a startup with very few employees. Is it mandatory to submit Form 5?

 If the establishment is covered under EPF (20 or more employees, or voluntarily covered with fewer employees), and any new person became an EPF member in a month, EPF Form 5 must be submitted by the 15th of the next month. Small team or big team does not matter once coverage applies.

3) What should be done if there is no new employee in the previous month?

Submit a NIL EPF Form 5 by the 15th. Many payroll tools generate a NIL return in one click. Keeping a NIL record avoids questions during labour inspections.

4) If an employee joined on 28th of January 2025, when should I include her details and submit Form 5?

 Include the person in January’s EPF Form 5 and submit it by 15 February 2025. Even late-month joinees must be reported in that same month’s return.
